How to Register Property | Property Registration in Delhi

property registration

Property Registration in Delhi is not merely a ritual, it is a legal process which establishes property ownership, ensures securing of your rights and makes any property deal within the law binding. A sale deed or conveyance deed stamped and registered with Sub-Registrar is strong and may be called upon to assure loans, resale, bequeath and resolution of disputes.

What Is Property Registration?

Registration of property is the procedure of transfer of property in the form of the sale deed (or any gift deed or lease deed etc.), the Registration Act, 1908, in the official records of the Sub-Registrar. Once it has been registered, the document is saved (mostly in electronic form) as evidence of the transaction and of the rights of the parties.

Registration of instruments which establish or transfer or restrict or extinguish rights in immovable property is not an option, but a legal requirement existing in Delhi. When a mandatory document is not registered, it will not be considered as evidence of change of ownership during a court session, and the title of the buyer will be weak and susceptible to loss.

Key Reasons Why Registration is Mandatory in Delhi.

• To make ownership legally acknowledged and a permanent record to the public.
• Eliminates the chances of selling the same property more than once and curbs fraud since transactions can be traced.
• Enables mutation of municipal and revenue records which are required in tax liability and utilities.
• Serves as good title proof in court when there are disputes on title or boundaries.
• Lack of registration of an obligatory document may result in:
• It is hard to establish ownership and enforce rights.
• Difficulties in selling, mortgaging, or acquiring a home loan on the plant.
• Potential fines, extra stamp tax, and interest in case underestimation or late registration is discovered.

The following are some of the properties that should be registered.

Residential apartments and houses: Builder flats, apartments, independent houses, cooperative society flats etc.

Commercial real estate: Shops, offices flats, commercial levels, warehouses in Delhi.

Leasehold to freehold (where applicable).

There are quite a number of older DDA and leasehold government property in Delhi that can be converted to freehold by executing a conveyance deed on payment of conversion charges and stamp duty and registration fee. When converted and registered, the owner enjoys full freehold rights and resale and mortgaging becomes easy.
