UPON hearing the counsel the Court made the following

O R D E R

1. These are interconnected matters, one a writ petition filed under Article 32 of the Constitution of India by the Medical Officers Association (Ayurveda), State of Gujarat, while the others are a set of miscellaneous applications moved by different affected persons including the National Commission for Indian System of Medicine (NCISM) – a statutory body, seeking modification of the judgment dated 26.04.2023 rendered by a two judge Bench of this Court in Civil Appeals No.8553-8557 of 2014 (State of Gujarat & Ors. Etc. vs. Dr. P.A. Bhati & Ors. Etc.).

2. It appears to us, prima facie, that the outcome of the miscellaneous applications/review applications moved by affected persons for modification/recall of the judgment dated 26.04.2023 will have some effect on the merits of the writ petition as well.

3. The said judgment was delivered by a Bench comprising Hon’ble Mr. Justice V. Ramasubramanian (since retired) and Hon’ble Mr. Justice Pankaj Mithal. It, thus, appears to us more appropriate if the writ petition as well as the miscellaneous applications/review applications are listed before a Bench in which Hon’ble Mr. Justice Pankaj Mithal is a member.

4. Let these matters, therefore, be placed before Hon’ble the Chief Justice of India for appropriate orders.
